Conclusion of the online sales contract

1. OBJECT OF THE ONLINE AGREEMENT AND ITS DEFINITION

By “online” sale contract is meant the distance contract and that is the legal shop for movable goods and / or services entered into between a supplier, in this case the site www.casitaliasrl.it of Casitalia Srl, Via Appia Antica KM 13.5 SN Zona Industriale Jesce – 75100 Matera (MT) and a consumer customer as part of a distance selling system organized by the supplier who, for this contract, uses only the remote communication technology called “internet”.
All contracts, therefore, will be concluded directly through access by the customer consumer to the website corresponding to the address www.casitaliasrl.it, where, following the indicated procedures, he will conclude the contract for the purchase of the goods. By consumer we mean the natural person who buys goods and services for purposes not directly related to any professional activity. Below are the conditions of sale which will remain effective until changed by the supplier. Any changes to the conditions of sale will be effective from the moment they are published on the website www.casitaliasrl.it and will refer to sales made from that moment on.

2. SALE PRICES AND PURCHASE METHODS

All the selling prices of the products displayed and indicated on the website www.casitaliasrl.it, for which they constitute an offer to the public pursuant to art. 1336 of the Italian Civil Code, include VAT and any other tax; the cost of transport is duly highlighted on the specific page on the site that the customer will take care of viewing before confirming the purchase; in the event of delivery abroad, any additional costs due to taxes or duties provided for by the legislation in force in the country of destination will be charged to the consumer. The purchase contract is perfected through the exact compilation and consent to the purchase manifested through the adhesion given “on line”. The customer can pay for the goods ordered using the payment methods indicated online at the time of purchase.
Casitalia S.r.l. reserves the right to request only the payment by advance bank transfer for amounts greater than 999 euros or for the customization of objects or custom-made processes.
The prices displayed on the site are to be considered valid only for orders placed online, with the possibility of picking up items directly in the shop by telephone agreement.

3. EXECUTION OF THE CONTRACT AND DELIVERY METHODS

Casitalia S.r.l. will deliver the selected and ordered products to customers, in the manner referred to in the previous article, through trusted couriers and / or shippers.
In case of absence of the recipient at the time of delivery, a notice will be left and the customer must personally contact the courier or shipper as soon as possible in order to agree on the delivery methods.
The delivery times, which will never exceed, in any case, those foreseen by art. 6 Decree Legislative. 185/1999 (30 days from the order date), may vary from the day of the order to a maximum of seven working days.
The aforementioned delivery times refer to the products present in the warehouse at the time of the order. In case of immediate unavailability of the products, it will be communicated via e-mail.
Delivery will be made by the carriers mainly at road level. However, no responsibility can be attributed to the supplier for delayed or non delivery due to force majeure or unforeseeable circumstances.

4. AVAILABILITY OF PRODUCTS

The customer can purchase the products indicated in the electronic catalog prepared (if present on the casitaliasrl.it website) and in the quantities in stock. If an order exceeds the quantity existing in the warehouse, Casitalia S.r.l. will notify the buyer of whether or not this product will be available in the future and the expected time of supply.

5. LIABILITY

Casitalia S.r.l. does not assume any responsibility for the disservices attributable due to force majeure such as failure to deliver by couriers, accidents, explosions, fires, strikes and / or lockouts, earthquakes, floods and other similar events that prevented, in whole or in part, execute the contract within the agreed time.
Casitalia S.r.l. will not be liable to any party for damages, losses and costs incurred as a result of the non-execution of the contract for the reasons mentioned above, having the consumer entitled only to the refund of the price paid.
Likewise Casitalia S.r.l. is not responsible for any fraudulent and illegal use that may be made by third parties, credit cards and other means of payment, when paying for the products purchased. Casitalia S.r.l. in fact, at no time during the purchase procedure is it able to know the credit card number of the buyer who, by opening a secure connection, is sent directly to the Bank which manages the service. At the request of the interbank service, which authorizes payment by credit card, Casitalia S.r.l. you can request a two-sided copy of your credit card, and a copy of your identity document, to be sent to the email address am@casitaliasrl.it.

6. WARRANTIES AND ASSISTANCE MODES

Casitalia S.r.l. markets high quality products for which it offers a guarantee of 24 months from the date of purchase.
Generally this service is directly provided by the manufacturers of the goods sold, but, if the customer prefers it, he can choose to be assisted by Casitalia S.r.l. for the stages of return and management of the return under warranty.
For this purpose, to allow Casitalia S.r.l. to correctly fulfill the assignment, the customer must request the return of the product by contacting Casitalia by telephone. on 0835 1825294
In any case, the reference legislation and the methods of application of the guarantee are those indicated and highlighted by the manufacturer in its certificate always attached to the product.
The consumer is protected by Legislative Decree 24/2002.

7. PURCHASER OBLIGATIONS

Once the “online” purchase procedure is concluded, the consumer undertakes and undertakes to print and keep these general conditions, which, moreover, he will have already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product being purchased, and this in order to fully satisfy the condition set out in articles 3 and 4 of the Decree Legislative. No. 185/1999.
It is strictly forbidden for the purchaser to enter false, and / or invented, and / or invented data, in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and e-mail must be exclusively their real personal data and not of third parties, or fantasy.
It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties.
Casitalia S.r.l. reserves the right to legally prosecute any violation and abuse, in the interest and for the protection of all consumers.

8. RIGHT OF WITHDRAWAL

Pursuant to articles 52 and ss. of the Consumer Code, the Consumer Customer has the right to withdraw from the Contract, without any penalty and without specifying the reason, within fourteen days of receipt of the product without having to provide any reason.
In the case of separate delivery of multiple goods, ordered by the Consumer Customer with a single order, the term of fourteen days for exercising the right of withdrawal starts from the day on which the last good is delivered.
The right of withdrawal is exercised within the aforementioned period of 14 days with a registered letter with acknowledgment of receipt to the following address Casitalia S.r.l. – Via Appia Antica KM 13.5 SN Zona Industriale Jesce – 75100 Matera (MT), or by e-mail to the address am@casitaliasrl.it.
In accordance with the provisions of article 59, lett. c) and d) of the Consumer Code, the Consumer Customer cannot exercise the right of withdrawal for Products made to measure or clearly personalized or which risk deteriorating or altering rapidly.
The Products for which the right of withdrawal is exercised must be returned within fourteen days from the day on which the Consumer Customer communicated the exercise of the right of withdrawal, substantially intact, in their original packaging, complete with accessories and any manuals, without no lack.
The only costs payable by the Consumer Customer for exercising the right of withdrawal are the direct costs of returning the goods, as required by Article 57, paragraph 1, of the Consumer Code.
Once the withdrawal request has been received, Casitalia S.r.l. will refund the entire amount paid by the Consumer Customer within fourteen days from the date on which the Consumer Customer exercised the right of withdrawal, by crediting the current account used at the time of purchase, or by using the bank details provided by the Consumer Customer with the notice of withdrawal and in any case using the same payment method used by the Consumer Customer at the time of purchase. Casitalia S.r.l. reserves the right to withhold the refund until it has received the Products subject to the right of withdrawal.
If, however, the methods, conditions and terms for exercising the right of withdrawal are not respected, as specified in this article, the Consumer Customer will not be entitled to a refund of the sums already paid. In this case, the Consumer Customer may re-obtain, at his expense, the Product in the state in which it was returned to Casitalia S.r.l. Otherwise, Casitalia S.r.l. may retain the returned Products, in addition to all the sums already paid by the Consumer Customer for the relative purchase. Shipping and transport costs are charged to the customer.

9. AUTHORIZATIONS

By filling in the space provided on the website, the customer authorizes Casitalia S.r.l. to use their credit card or other card issued to replace it and to charge the total amount shown as the cost of the purchase made “online”.
All the procedure is done through a secure connection directly connected to the Banking Institute, owner and manager of the “online” payment service, to which Casitalia S.r.l. cannot log in.
At the request of the interbank service that authorizes payment by credit card, Casitalia S.r.l. can request a copy of the credit card, front and back, and a copy of the identity document, to be sent by email to am@casitaliasrl.it.

10. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE

Casitalia S.r.l. has the right to terminate the stipulated contract by simply communicating it to the customer with adequate and justified reasons; in this case the customer will be entitled only to the refund of any sum already paid.
The obligations assumed by the customer pursuant to art. 7 (Obligations of the buyer), as well as the guarantee of the successful completion of the payment that the customer makes with the means referred to in art. 2, have an essential character, so that by express agreement, the Customer’s failure to fulfill only one of these obligations will determine the legal termination of the contract pursuant to art. 1456 of the civil code, without the need for judicial judgment, without prejudice to the right for Casitalia Srl to take legal action for compensation for further damage.

11. CONFERENCE AND PROCESSING OF PERSONAL DATA

Personal data are collected for the purpose of registering the customer and activating the procedures for the execution of this contract and the related necessary communications; these data are processed electronically in compliance with the laws in force and can be presented only upon request of the judicial authority or other authorities authorized by law for this purpose.
Personal data will be communicated to subjects delegated to carry out the activities necessary for the execution of the contract stipulated and disclosed exclusively for this purpose.
The interested party enjoys the rights of Legislative Decree 196/2003 (Code regarding the protection of personal data), namely:

to ask for confirmation of the existence at Casitalia S.r.l. of your personal data;
to know their origin, logic and purpose of their treatment;
to obtain its updating, rectification and integration;
to request cancellation, transformation into anonymous form or block in case of illegal treatment;
to oppose their treatment for legitimate reasons or in the case of use of the data for sending advertising material, commercial information, market research, direct sales and interactive commercial communication.
